Test Drive Liability Waiver Template

1. Driver information

Driver agrees to provide a current, valid driver’s license and proof of insurance prior to operating the vehicle. Driver represents that the identifying information provided (name, address, license number, date of birth) is true and accurate.

2. Vehicle information

Driver acknowledges that the dealership is authorizing operation of the vehicle identified by VIN, stock number, year, make, and model as recorded at the start of the drive.

3. Purpose and duration

The test drive is solely for the purpose of evaluating the vehicle for potential purchase. Driver agrees to operate the vehicle only during the time period authorized by the dealership representative and to return the vehicle to the dealership at the agreed return time.

4. Insurance and financial responsibility

Driver represents that they maintain valid automobile liability insurance covering the driver for the operation of vehicles not owned by them, or accepts financial responsibility to the same extent. Driver understands that the dealership’s garage liability policy may provide only secondary coverage, if any, for damages or injury caused by driver’s operation of the vehicle.

5. Driver responsibility

Driver agrees to operate the vehicle in a safe and lawful manner, in compliance with all applicable traffic laws, and assumes full responsibility for any traffic violations, citations, fines, tolls, parking charges, or other penalties incurred during the test drive.

6. Limitation of liability

To the fullest extent permitted by law, driver releases and holds harmless the dealership, its officers, employees, and agents from any claim, loss, or damage arising out of driver’s ordinary negligence in the operation of the vehicle. Nothing in this waiver is intended to waive liability for gross negligence, intentional misconduct, or any claim not permitted to be waived by law.

7. Communication consent (TCPA)

Driver consents to receive communications from the dealership regarding the vehicle and the test drive, including communications by phone, SMS, and email, at the phone number and email address provided. Driver may revoke consent at any time by contacting the dealership.

8. Electronic signature

Driver consents to transact business electronically and agrees that an electronic signature has the same legal effect as a handwritten signature under the federal ESIGN Act and applicable state UETA.

9. Entire agreement

This waiver constitutes the entire agreement between the parties with respect to the test drive and supersedes any prior understandings. Any modification must be in writing.
